I, Allen Belote, do hereby make application to the Commissioner of Pensions for a pension to be granted me under the Act passed by the 33rd Legislature of the State of Texas and approved April 7, 1913 on the following grounds:
I enlisted and served in the military service of the Confederate States during the War Between the States of the United States, and that I not desert the Confederate service, but, during said way I was loyal and true to my duty, and never at any time voluntarily abandoned my post of duty in the said service; that I was honorably discharged at Hempstead, Texas, June 1865,
That I have been a bona fide citizen of this State since prior to January 1, 1900 A.D., and have been continuously since a citizen of the State of Texas. I do further state that I do not hold any National, State, City or County office which pays me a salary or fees of $300.00 per annum, nor have I an income from any other employment or other source whatever which amounts to $300.00 per annum, nor do I receive from any source whatever money or other means of support amounting in value to the sum of $300 per annum, nor do I own in my own right, nor does any one hold in trust for my benefit or use, nor does my wife own, nor does any one hold in trust for my wife, estate or property, either real, personal or mixed, either in fee or for life, of the assessed value of over one thousand dollars, exclusive of a home of the value of not more than $1,000.00; nor do I receive any aid or pension from any other State, or from the United States, or from any other source, and that I am not an inmate of the Confederate Home, and I further state that the answers given to the following questions are true:

Wherefore your petitioner prays that his application for a pension be approved and such other proceedings be had in the premises as are required by law.

CERTIFICATE OF STATE AND COUNTY ASSESSOR
I, J.F. Kirkland, State and County Assessor in the County of Marion, State of Texas, do certify that Allen Belote, or his wife, or his trustee, or trustee for his wife, whose name is signed to the foregoing application for a pension, under the Act of the Thirty-third Legislature, approved April 7, 1913, is charged on the tax rolls of said county with a homestead of the value of $500.00 and of other property, real or personal, or both of the value of $255.00 (personal).

The Honorable County Judge of Marion County, Texas will please take notice that, five days after service hereof, applicant herein will apply to the clerk of the County Court of said County and State for a commission to take the depositions of J.C. Hutchinson who resides in the County of Bowie in the State of Texas in answer to the following interrogatories and such cross interrogatories as may be propounded by the County judge of said County, which will be read in evidence upon the hearing of applicants claim for pension in behalf of applicant; said testimony is material and indispensable to applicant in furnishing the required proof of his claim for a pension under the Act of April 7, 1913, the application for which is now pending before the Honorable County Judge and the facts necessary and required to be proven under the provisions of said act, applicant believes cannot be proven by any witness residing in the County of Marion and the State of Texas, which is a bona fide resident.

Do you know further if Allen Belote was, under the provisions of the conscript law, detailed for any kind of special service in the field, shops, armories, etc. of the Confederacy? He volunteered
What was the nature of his service, and how long did he serve? As a Private in Co. A, 19th Texas Infantry

If, in answer to the foregoing direct interrogatories, you have stated that you personally know or did know said Allen Belote and that you know that he enlisted in the service of the Confederacy and performed the duties of a soldier and having named the company and regiment, or special service in which Allen Belote so enlisted and served, then please state fully what is your source of such knowledge? Was in the same Company with him.
And state whether or not you know or at any time knew of any other soldier by the name of Allen Belote serving in the same company or regiment in which you way the said Allen Belote enlisted? He is the only one by the name in the 19th Reg.
Are you positively certain that said Allen Belote is the identical person serving as testified by you? Yes
Do you know whether or not the said Allen Belote served honorably from the date of his enlistment until the close of the late Civil War Between the States or until he was discharged from said company and regiment? Yes
Do you know whether or not the said Allen Belote deserted
his command or voluntarily abandoned his post of duty or the service during said war?
He never missed a roll call from the time of his enlistment until the close of the
war. There is not a blot on Allen Belotes character as a Confederate soldier.

AFFIDAVIT OF WITNESSES

Before me a Notary Public in and for Blaine County and State of Oklahoma, personally appeared William Louis Hartgraves and on his oath answers the interrogatories in the case of Allen Belote who is a claimant for pension before the Honorable Commissioners Court of Marion County, Texas and the Honorable Judge of said County as follows:
Interrogatory #1: What is your name? Age? Present place of residence and Post Office Address? William Louis Hartgraves. I am seventy years old and I live eight miles northwest of Geary, Blaine County, Oklahoma on Rural Route No. 2
Interrogatory #2: Do you personally know, or did you at any time know Allen Belote who is an applicant for pension under Act of May 12, 1899. I am personally acquainted with Allen Belote who appears to be an applicant for pension under the pension laws of the State of Texas.
Interrogatory #3: How long have you known the said Allen Belote, applicant for pension? When and where did you first know him? I first met Allen Belote in the summer of 1861 (We were old school mates.) in Marion County, Texas after which time we were intimate associates living in the self same neighborhood excepting while we were in the Confederate Army where we were in the same company and regiment. In the year of 1871 I left Marion County, Texas and since that time have known nothing except what I have heard about the said Allen Belote.
Interrogatory #4: Do you personally know that the said Allen Belote, applicant for pension, enlisted in the service of the Confederacy and performed the duties of a soldier? Yes I personally know that Allen Belote enlisted in the Confederate Army and performed the duties of a soldier.
Interrogatory #5: Do you personally know in what company and regiment the said Allen Belote, applicant, enlisted and served in the Confederate Army? When? Where? Time of service? Allen Belote served in Company A, 19th Texas Infantry. I am not certain about the date of enlistment, but think it was in the summer of 1864 and I cannot say just where the command was when the said Allen Belote reported for duty. I believe it was Arkansas or Louisiana, one or the other. I think he served about twelve months.
Interrogatory #6: Do you further know that Allen Belote, the said applicant for pension, is unable to support himself by labor of any sort? No, I do not know the said Allen Belotes present conditions, physically or financially.
ANSWERS TO CROSS INTERROGATORIES
Cross Interrogatory #1: If, in answer to the foregoing direct interrogatories, you have stated that you personally know or did know said applicant, and that you know that he enlisted in the service of the Confederacy and performed the duties of a soldier and having named the company and regiment in which applicant so enlisted and served, then please state fully what is your source of such knowledge? And state whether or not you know or at any time you knew of any other soldier or sailor by the name of Allen Belote serving in the same company or regiment in which you say the said applicant, Allen Belote enlisted? I was a private in the same company (Company A, 19th Regiment, Texas Infantry) in which the said Allen Belote enlisted and served as a Private. Also, I knew the said Allen Belote two or three years before he enlisted in the said Co. A, 19th Texas Infantry. I never knew any person by the name Allen Belote except the said applicant herein referred to.
Cross Interrogatory #2: Are you positively certain that said Allen Belote, applicant for pension, is the identical person serving as testified by you? I have no reason whatever to doubt that the said Allen Belote is one and the same person who served side by side with me in Company A, 19th Texas Infantry C.S.A.
Cross Interrogatory #4: Do you know whether or not the said Allen Belote, applicant for pension, ever deserted the service in the Confederate Army. The said Allen Belote was true to the Confederate cause from start to finish and we came home together in company with both our company and regimental officers.
I will further state that I have no pecuniary or other personal interest in the matter of the said Allen Belotes obtaining a pension

APPLICATION FOR MORTUARY WARRANT
STATE OF TEXAS
COUNTY OF MARION
I, J.V. Belote, do hereby certify that I am the person to whom is entrusted the paying of the accounts and indebtedness of the late Allen Belote, who was a pensioner of the State of Texas and whose file number is 32598 and whose original county is Marion.
The said pensioner, Allen Belote, died on the 5th day of May, 1923, in the town of Lodi Rt # 2, County of Marion, Texas.
The pensioner died in the home of J.V. Belote, who was related to the pensioner as Father.
That the warrant, which application is hereby made for, shall be applied to paying all or part of the expenses incurred by the said Allen Belote.
I further certify that the warrant for the current quarter has not been cashed by the pensioner, to the best of my knowledge and belief.
I am related to the pensioner as son and that my home is in the town of Lodi Rt #2, County of Marion, State of Texas and that my post office address is Lodi Rt #2.

CERTIFICATE OF UNDERTAKER
I, G.T. Haggard, do certify that I am an undertaker in the town of Jefferson, County of Marion, State of Texas; that I had charge of the body of Allen Belote, who died near the town of Lodi, County of Marion, State of Texas, on the 5th day of May, 1923. That said body was prepared for burial by me on the 5th day of May, 1923. That said body was buried in the Old Foundry Cemetery, which is located in the County of Marion, State of Texas; and that I am of the opinion that warrant herein applied for should be issued to the said J.V. Belote, who makes the foregoing application.

CERTIFICATE OF PHYSICIAN
I, R.L. Futrell, do certify that I am a practicing physician and that attended Allen Belote in his last illness and am of the opinion that his ailments were Enlarged prostate gland, Toxemia from uremic origin, Acidosis and Death.
I further certify that I am of the opinion that the Mortuary Warrant above requested should be issued in the name of the aforementioned applicant, in accordance with Act passed by the Thirty-fifth Legislature and approved March 2, 1917.
